General

The information contained in this brochure is intended to be by way of guidance to the Tour Participants and every reasonable care is taken to ensure that the details contained there in are accurate to the extent possible. It is however likely that there may be changes from what has been stated arising on account of any changes in the environmental circumstances inclusive of the infrastructure conditions like the roads, the transportation facilities, communication facilities, changes that may abruptly take place in the management set up of the Indian restaurants etc. which might necessitate review of information given in the brochure for facilitating appropriate changes to be made where ever necessary in the interest of ensuring smooth tour schedule. It shall be our endeavour to give advance information of any of the changes wherever feasible which may not however be all the while possible, as the brochures are prepared sufficiently in advance of the conducting of the tours and there may be events like major trade fairs taking place at the programmed visit centres it may become necessary to make subtle changes in the hotel accommodations keeping in view the availability of rooms and comfort level.

Hotels

We have taken utmost care to select the hotels so as to ensure reasonable level of comforts with all the desired amenities in keeping with the tour objectives as preferred by the Tour Participants. There may be instances where the hotels may not have air conditioners or fans primarily because of the climatic conditions in such centres being of Mediterranean nature dispelling the need for AC or fans in view of the weather being cold.

It may further be noted that most of the hotels do not allow more than 3 adults to be accommodated in a room. As such it may become necessary to work on convenient options at such centres where it becomes necessary to make changes. The participants may further note that the room sizes are generally uniform and as such the third bed provided would be a rollaway cot/ bed put in a double bed room. It shall be our endeavour to minimise the inconvenience or discomfort to the extent possible and feasible.

Meals

Reasonable care has been taken to ensure availability of quality Indian/ Continental meals at each of the centres. Appropriate information/guidance will be made available to the Tour Participants from time to time as regards the type of meals that will be served. It is however likely that at some of the centres it may not be possible to ensure flexible meal arrangements suiting to specific preferences of the Tour Participant/s in view of the local conditions and constraints.

It is necessary to adhere to the time schedule fixed by the hotels for the meal services. No claim for any refunds can be entertained if the Tour Participants tend to miss any of the meals due to delayed reporting. In the interest of the tour participant/s it will become necessary for us to make suitable changes in the meals schedule / preferences.

Important Precautions

The Tour Participant/s are advised to take care of their valuables or to deposit the same in safe deposit lockers that are available in most of the hotels to safe guard against possible loss/ theft etc. It would be preferable to exercise safety precautions even in the coaches, so as to ensure that the valuables remain safe. We will not be responsible for safety of any of the personal baggage and travel documents including the passport during the entire tour schedule.

The Coach seating arrangements: For all the visit schedules we have arranged air conditioned/ air cooled coaches and it would become necessary in the common interest of Tour Participants to adopt system of seat rotations on daily basis, while on board the coaches in view of which no seat numbers would be allotted to the Tour Participant/s.

Currency & Travellers Cheques (TC)

The Tour Participant/s are advised to take their holiday spending money partly by way of currency notes and traveller’s cheques.

Travellers Cheques are considered by far the safest way to carry money as they are easily encashable for a small service fee and could be replaced in case any Travellers Cheques are stolen/ lost provided however the Tour Participant/s carry the counter foils of the Travellers Cheques.

Itinerary Changes

With a view to ensuring optimum comfort and convenience for our Tour Participant/s. We may make certain desirable changes in the itinerary. It shall be our endeavor to make available in advance information about the same whenever any changes are to be made in the schedule as contemplated. It is absolutely necessary to ensure punctuality and promptitude so that none of the Tour Participant/s tend to miss out any of the sightseeing program. If any of the Tour Participants tend to miss out any of the sightseeing programs on account of their delayed reporting we will not be liable to consider any claim for refunds for the same.

Scope of Activity

The tour schedule is programmed in our capacity as a travel and tour operator. The company does not have any control on any of the airlines, transport operators, hotels and other facilities other than by way of indenting for services as given in the brochure. The company has offered the holiday packages to the participants and would ensure that such tours meet with the normal expectations, Within the specified constraints . While the company has taken reasonable care to comply with all the amenities as offered in the tour program, there may however be need for making changes as regards any of the amenities inclusive of hotels, meals, transport arrangements, entertainment etc.

Under specific circumstances that are beyond the control of the company as travel and tour operator and as such the company not being liable to make any refunds or claims as may be preferred by any of the participants. The company shall also not be responsible for any unexpected delay or deficiency in the services provided by any of the agencies and /or for the act or action of any of the co- travellers and /or any of the co-passengers while on tour as the company’s role remains restricted to being a tour co-ordinator and organiser.

Registration

The tour participant/s are advised to read the detailed brochure furnished about the tour program including the Booking Terms & Conditions and guidelines mentioned therein before signing the Registration form. While the submission of duly signed Registration form would imply the unconditional & binding acceptance of all the terms and conditions as provided therein, the company reserves the right to consider or reject any of the registration forms, without assigning any reasons whatsoever for the same or the company not being in a position to go ahead with any specific tour as per indicated schedule for whatsoever reason.
 

DEFINITIONS

  • Tour participant :
    The person/ persons in whose name and on whose behalf the booking is made and / or whose name/s appears on the Registration form, provisional/ confirmed Passenger Tour Ticket.

  • The Company :
    The company means Bulls & Bears Finance Ltd. - Travel & Tours division with its brand name as Lifestyle Holidays

  • The Independent Supplier / contractor/ agency :-
    Would mean any hotelier / hotel owner / airlines agency / airlines / shipping / cruise company / railway / ferry boat owner-operator / luxury coach owners-operators opera/concerts owners-operators or any other person or organisation who have been selected by the company to render services to the participant/s.
 

There is no contract emerging between the company and the Tour Participant until the company has received a non refundable deposit as stipulated. The full payment must be received in accordance with the procedures laid down in the Booking Guidelines. If not paid within stipulated time the company reserves the right to cancel the booking with the forfeiture of deposit amount and also apply scale of cancellation charges as mentioned in the Booking Guidelines. The company has the right at any time and for any reasons to terminate the contract after acceptance of deposit but prior to the commencement of the tour without assigning any reason whatsoever. In case the company terminates the contract the company would arrange to refund the amount of deposit collected if any to the tour participant/s without any interest payment being applicable.

The company has the right to amend /alter/ vary or withdraw any tour holiday excursions or facility that had been advertised or published or to substitute an independent contractor of equally good class as it may deem fit advisable and necessary. In either of the cases the company shall not be liable for any damage, loss or additional expenses/ consequential loss if any suffered by the tour participant/s and/or for any other form of compensation claim as may be preferred by the tour participant/s.

It is the sole responsibility of the tour participant/s to hold valid travel documents such as passports and visas and to furnish all the documents required by the company in connection with the tour. Wherever any application for any visa as may be made by any tour participant/s or by the company on behalf of the tour participant/s is rejected by the concerned authorities/embassy/ consulates of the country concerned being due to the inadequacy of the documents furnished by the participant/s or due to any other reason the company shall not be liable/responsible for the same any / all the costs/ charges irrespect of the said application for visa shall be borne by the Tour Participant/s. The company shall also not be liable for any claims forth coming from the participant/s consequent to the denial of visas as specified herein above.

Insurance

It is essential for the participants to carry a valid and effective health insurance policy while on tour to safe guard against any exigency, ailment, accident etc. The company will be arranging to get the policies issued to all the tour participant/s through one of the reputed Insurance Companies having the necessary agency arrangement overseas for rendering timely services. The cost of the premium payable is already included in the tour price. However it is responsibility of the Tour Participant/s to communicate in details with essential health document as regards any previous history of ailments as would be necessary during the tour to exercise the requisite precaution, which is also one of the essential terms of the overseas insurance policy that would be issued. The Insurance Company won’t assume any responsibility for any consequences arising on account of any concealed health information.

The company reserves the exclusive rights to provide for any other Terms & Conditions &/or amend any of the stipulated conditions as may be found to be necessary solely at its discretion.

The company shall not under any circumstances be liable to the Tour Participant/s for any death, injury, sickness, accident, loss/ damages as may be suffered for any reason whatsoever .

The company shall not be liable for any losses as may be suffered by the Tour Participants consequent to any act of negligence on their part while on tour.

The company shall not be liable for any exigencies wherein the tour participant/s booked on a particular flight is/are not allowed to board the flight for whatsoever reason by the airline concerned and is/are allowed to board an alternative flight and/or for any other reason.

The company shall not be liable or responsible for any damage or losses suffered by the participants while on tour due to factors falling under any of the Force Majeure conditions.

The company shall not be liable for any consequences arising on account of any unenvisaged local holiday in the places of visit leading to cancellation of scheduled visits.

Baggages

The tour participant/s travelling by air shall be subject to the Airlines restrictions / limitations as regards baggage carriage in terms of weight, size, number of pieces etc. as would be permissible and any baggage as are not allowed shall be the exclusive responsibility of the tour participant/s.

It is to be clearly understood by the participants that no liability as likely to arise on the company on any account relating to any counter claim on any grounds pertaining to the tour can exceed the total amount paid or agreed to be paid by the participant/s and any such claim as may be preferred by the participant/s shall be subject to terms and conditions as provided herein and accepted in full by the tour participant/s by way of affixing his signature thereon.

If the Tour Participant/s were to have any complaints as regards any elements of service at any point the same shall be brought to the attention of the tour manager for need full to be done to the satisfaction of the Tour Participant/s within the prevailing limitations.

Refund

The company reserves the right to determine the quantum of refund as applicable in the event of any unenvisaged cancellation or amendment of the tour schedule either in part or in full due to Force Majeure conditions. Such refund applicability in terms of quantum would be based on factors like the number of Tour Participants the cancellation policies of supplier, hotelier, coach operator and other agencies. The decision as concluded by the company shall be accepted by the Tour Participant as final and shall not be disputed on any account. Such refunds if any as may be applicable shall be paid directly to the Tour Participant by the company after adjustment of the expenses incurred by the company on the tour apart from the payments made / to be made to other agencies as per contractual obligations. It would take atleast 45 days to process such refunds.

In case the company where to exercise the discretion to alter, amend/ cancel the tour advertised in the Brochure either in part or in full, the Tour Participant who has registered for such tour as altered or amended or to accept any alternative tour which the company may offer. The company shall not be liable for any claim for compensation, damages additional expenses or any consequential losses arises as may have been suffered by the tour participant/s or to pay any amount as refund to the Tour Participant.

Even in case of a tour for which the payment would have been made in foreign currency with or without part payment in INR the refund shall be made only in INR as per prevailing rates on the prevailing rates on the date of refund in accordance with the then existing rules and regulations of the appropriate authorities.

There shall be no refund entitlement if the Tour Participant fails to tour the group at the commencement of the tour or where to be joining the group prior to the completion of the tour. There shall be no refund entitlement if the Tour Participant fails to join the group at the commencement of the tour or were to be leaving the group prior to the completion of the tour.

There shall also be no refund applicable wherever the participant does not or cannot utilize any service included in the Tour Cost like the meals, room, excursions etc. On any specific grounds nor can any refund be applicable for any case for lost / misplaced/ destroyed travel tickets or vouchers.

Conditions of Travel

The Tour Participant/s shall have to strictly adhere to the Tour Program and return to India within the validity of the Air Tickets.

It shall be noted that for all purpose it shall be the responsibility of the Tour

Participant/s to reach the place of commencement of the Tour and register with the Tour Manager / Company representative at the appointed place / date and time.

The Tour Participant/s shall not behave in a manner which may cause any inconvenience or embarrassment or distress to the co-participants or give room for any risk by way of damage to the property of the company or the co-participants .

For all claims, disputes or grievances of whatsoever nature relating to the tour marketed / coordinated by the company the jurisdiction applicable shall be exclusively restricted to the courts in Mumbai.

All the tours are subject to the Rules & Regulations/ provisions as stipulated by the RBI, GOI and other appropriate authorities and bodies as are binding on the company as Tour Operator and also the Tour Participant/s in terms of the applicable provisions for undertaking overseas Tour.
